Welcome to Sojourney! These Terms of Service ("Terms") govern your access to and use of the Sojourney website, services, and applications (collectively, the "Platform"). Please read these Terms carefully.

By creating an account or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.

1. Your Sojourney Account

Eligibility: You must be at least 13 years old to use the Platform. If you are accepting these Terms on behalf of an organization or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Account Security: You are responsible for safeguarding your account. Keep your password confidential and notify us immediately of any unauthorized use of your account.

Account Information: You agree to provide us with accurate, complete, and updated information for your account.

2. The Sojourney Platform

Sojourney provides a social learning platform where members can adopt "Pursuits" (learning objectives), discover, submit, and vote on learning "Resources" (such as articles, videos, and tools), and connect with other members by following them. The Platform uses a personalized algorithm to rank resources based on the activity within a member's network.

3. User-Generated Content

You are responsible for the content you submit to the Platform, including resource links, votes, and any other materials ("User Content").

Ownership: You retain ownership of the User Content you create.

License You Grant to Us: By submitting User Content to the Platform, you grant Sojourney a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, and prepare derivative works of your User Content in connection with operating, developing, and providing the Platform and its services. This license is for the limited purpose of making the Platform and its services available to you and other members. For example, we need the right to display your votes to calculate scores for other members and to show your profile to those who view it.

Our Right to Remove Content: We reserve the right to remove any User Content that violates these Terms or our community guidelines, or is otherwise objectionable, at our sole discretion.

4. Acceptable Use & Community Guidelines

To keep Sojourney a safe and effective place for learning, you agree not to:

• Post any content that is illegal, defamatory, harassing, hateful, or obscene.
• Engage in spamming, phishing, or sending unsolicited communications.
• Impersonate any person or entity or falsely state your affiliation.
• Use bots, scrapers, or other automated means to access the Platform or manipulate the scoring algorithm through inauthentic activity (e.g., vote manipulation, creating fake accounts).
• Attempt to reverse engineer, decompile, or otherwise discover the source code of the Platform.
• Interfere with or disrupt the integrity or performance of the Platform.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Our Intellectual Property

The Platform and its original content, features, and functionality (including but not limited to all software, text, graphics, logos, and the "Sojourney" name) are and will remain the exclusive property of Sojourney and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Copyright Policy (DMCA)

We respect the intellectual property rights of others. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the information specified in our Copyright Policy.

7. Termination

By You: You can terminate your account at any time through your account settings.

By Us: We may suspend or terminate your account at any time, with or without notice, for any reason, including for a breach of these Terms.

Effect of Termination: Upon termination, your right to use the Platform will immediately cease. We may retain your User Content (such as votes) in an anonymized, aggregated form to maintain the integrity of historical data on the Platform, but it will no longer be associated with your personal account.

8. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Sojourney makes no warranties, express or implied, regarding the service, including that it will be uninterrupted, error-free, or secure. We do not endorse, guarantee, or assume responsibility for the accuracy or reliability of any resource, opinion, or content submitted by members.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Sojourney, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

10. Indemnification

You agree to defend, indemnify, and hold harmless Sojourney and its employees, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Platform or your violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of California, without regard to its conflict of law provisions.

12. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you (for example, by email to the address associated with your account). By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.
